Greeley Man Sentenced to Probation for 2016 Cannon Death

A Greeley man has been sentenced to probation for a fatal cannon incident that happened nearly five years ago.

33-year old Max Fenton has taken a plea deal, pleading guilty in Delaware County District Court to an aggravated misdemeanor charge of involuntary manslaughter. He originally faced a felony version of that charge.

Authorities say during a gathering at his Greeley home over the Fourth of July weekend in 2016, Fenton fired a homemade miniature cannon made from a sawed-off barrel of a .50-caliber black powder rifle. The rear portion of the barrel blew out fragments, hitting 55-year old Lori Heims of Edgewood in the head. Heims died from her injuries.

A tentative trial date was set for April 2020, but hearings had been put on hold until September due to COVID. The trial was then pushed back again until February.

On Friday, Judge Monica Wittig sentenced Fenton to two years of probation, with a two-year prison term suspended.
