A Holy Cross man has been sentenced for unlawfully possessing a firearm as a convicted felon.
44-year old Brett Schmerbach was sentenced to one year in federal prison Tuesday.
Schmerbach pleaded guilty last fall, admitting that he possessed three guns in late 2016 after twice being convicted of operating while intoxicated. The guns were found at Schmerbach’s home while police were searching his residence pursuant to a search warrant. Besides the guns, officers also found methamphetamine, drug paraphernalia and ammunition.
In addition to his prison sentence, Schmerbach was also fined $5,500. He must also serve a 3-year term of supervised release after the prison term.
Schmerbach is being held in U.S. Marshal’s custody until he can be transported to a federal prison. Schmerbach was originally released on supervised release following his indictment, but was later detained after he failed to follow the conditions of his release.
