DES MOINES, Iowa (AP) – The Iowa Court of Appeals has reversed the second-degree murder conviction for a man accused of killing a Western Dubuque graduate and ordered a new trial.
The court concluded Wednesday that Fontae Buelow of Dubuque should have been allowed to present evidence of his girlfriend Samantha Link’s history of suicide attempts and mental health issues.
Link, from Peosta, was a graduate of Western Dubuque High School.
Buelow denied he stabbed her in 2017 and claims she committed suicide by stabbing herself.
The court says he should get a new trial that includes the background evidence.
