Sentencing Delayed Second Time for Burns

Sentencing has been delayed a second time for a Manchester man convicted of killing a Cedar Rapids teenager 40 years ago.

Jerry Burns will be sentenced August 7th in Linn County District Court.

Burns was found guilty of First Degree Murder in the death of Michelle Martinko during a trial earlier this year. Martinko was found stabbed to death in her parents’ car at the Westdale Mall parking lot in December 1979. DNA evidence led investigators to arrest Burns in 2018.

Sentencing was originally scheduled for April 17th, but the coronavirus led Iowa’s court system to delay criminal court proceedings, so it was pushed back the first time to June 19th.

Assistant Linn County Attorney Nicholas Maybanks says it was then delayed a second time until August 7th. Maybanks tells KMCH if a defendant desired to be personally present for their sentencing, in-person sentencings were delayed until at least August 3rd.
